The Law promotes the use and development of AI as part of Peru's national digital transformation process, with an emphasis on human rights and the ethical, sustainable, transparent and responsible use of AI. It establishes principles including risk-based security standards, responsible AI development, privacy and participation by public- and private-sector stakeholders.

The Regulation establishes a risk-based framework for AI development, implementation and use in Peru, identifying prohibited and high-risk uses and imposing obligations on private-sector AI developers and implementers concerning transparency, documentation, privacy, accountability and human oversight. It phases in specified private-sector requirements by industry, generally over one to four years, with separate timelines for micro and small enterprises.

The Law amends Peru's Criminal Code and Computer Crimes Law to address the misuse of AI in criminal conduct, including by making improper use of AI or similar technologies an aggravating circumstance for criminal liability. It also amends specific offenses involving matters such as sexual exploitation, defamation, fraud and intellectual-property crimes to address conduct involving AI and related technologies.

The Bill would amend the Criminal Code to criminalize the nonconsensual creation, generation or manipulation using AI or other digital technologies of realistic sexual images, videos or audio. It would establish enhanced penalties in specified circumstances, including cases involving minors, persons with disabilities and certain personal, employment or educational relationships.
