Damian Mencini is the Senior Cyber Advisor in Morrison Foerster’s Privacy + Data Security and Crisis Management practice groups.
Damian draws on his law enforcement experience to help clients navigate cybersecurity and national security matters.
Damian’s practice involves advising on cybersecurity incidents and notification obligations, sensitive data privacy and U.S. national security matters, internal investigations, insider threats, responses to law enforcement requests, and issues arising under the Electronic Communications Privacy Act, Foreign Intelligence Surveillance Act, Foreign Agent Registrations Act, and federal regulatory regimes.
Prior to joining Morrison Foerster, Damian held multiple positions at the Federal Bureau of Investigation (FBI), including as the national security policy advisor to the FBI Director and Deputy Director. In this role, Damian managed the FBI’s participation in White House National Security Council meetings and engagements across the Executive Branch and Intelligence Community and advised FBI senior leadership on national security threat response and policymaking.
At the FBI, Damian was selected by the Deputy Director to lead the agency’s data analytics initiative and developed the FBI’s legal and operational playbook for conducting digital investigations. He also provided support for multiple counterterrorism critical incidents and served as a special advisor to major national security investigations.
Damian received the U.S. National Intelligence Community Meritorious Unit Citation for his role in countering foreign influence and cyber threats in the 2018 U.S. midterm elections and multiple FBI Exceptional Performance awards.
Damian holds a J.D. from Georgetown University Law Center and a B.A. from Boston College, where he graduated as a Scholar of the College.
