Emma Burgoon is an associate in Morrison Foerster’s Litigation Department, where she focuses her practice on complex litigation, with a particular emphasis on data privacy class actions.
Emma has experience defending companies against a wide range of common law and statutory privacy claims, including claims brought under the California Invasion of Privacy Act (CIPA) and the Illinois Biometric Information Privacy Act (BIPA). She regularly represents clients in high-stakes, high-exposure litigation involving emerging privacy theories and technologies.
Emma has worked across all phases of the litigation lifecycle. Her experience includes managing large-scale and high-volume discovery processes, taking and defending depositions, and briefing and arguing dispositive motions.
An experienced legal writer, Emma has drafted or contributed to motions to dismiss, motions for summary judgment, discovery motions, mediation statements, and oppositions to class certification.
Emma maintains an active pro bono practice focused on immigration law. She has secured the release of a client from immigration detention through a successful habeas petition and has helped multiple clients adjust their status to lawful permanent residents. Emma is fluent in Spanish.
