Joseph (“Joe”) Toth is an associate in the firm’s Investigations + White Collar Defense Group in the Washington, D.C. office.

Joe focuses his practice on representing companies, boards of directors, and executives in internal and government-facing investigations, white collar defense matters, and regulatory and global compliance exercises.

Joe has extensive experience in matters involving alleged wrongdoing related to the Bank Secrecy Act (BSA)/anti-money laundering (AML) laws, bribery and the Foreign Corrupt Practices Act (FCPA), the False Claims Act (FCA), sanctions, healthcare fraud, and other forms of financial misconduct. He has conducted internal investigations related to these issues and has also represented clients in government-facing investigations conducted by the U.S. Department of Justice (DOJ), the U.S. Securities and Exchange Commission (SEC), Congress, the U.S. Department of Treasury’s Office of Foreign Assets Control (OFAC), and the U.S. Department of Health and Human Services Office of Inspector General (HHS-OIG), as well as other non-U.S. regulators and law enforcement agencies. Several government-facing representations Joe has worked on have resulted in favorable resolutions or no action taken against his clients.

He also routinely counsels clients on global compliance matters, including on third-party due diligence, transactional due diligence, and compliance program risk assessments.Prior to joining Morrison Foerster, Joe clerked for the Honorable Matthew H. Solomson at the United States Court of Federal Claims.

Joe received his J.D. with Highest Honors from the George Washington University Law School, where he served as a managing editor of The George Washington Law Review. While in law school, Joe interned for the Department of Justice’s Public Integrity Section, the U.S. Senate’s Permanent Subcommittee on Investigations, the Department of Justice’s Aviation, Space & Admiralty Litigation Section, and the United States District Court for the District of Columbia. He also served as a research assistant for Assistant Dean Jessica Tillipman.

Joe graduated from the University of Maryland with a B.A. cum laude in government & politics and English.

Internal and Government-Facing Investigations
  • Representation of McKinsey & Company, Inc. in securing a three-year, $122.85 million deferred prosecution agreement with DOJ and the National Prosecuting Authority of South Africa to resolve FCPA violations involving bribes to officials in South Africa.
  • Representation of McKinsey & Company in securing a five-year, $650 million deferred prosecution agreement and civil FCA settlement with DOJ and Corporate Integrity Agreement with HHS-OIG arising from McKinsey’s past work for opioid manufacturers, including Purdue Pharma.
  • Representation of a leading multinational medical device and pharmaceutical company in numerous internal investigations of alleged healthcare fraud, corruption, and accounting issues across North America.
  • Representation of a multinational financial services corporation in a cross-border DOJ investigation into alleged violations of OFAC sanctions and AML regulations.
  • Representation of an online banking service and payment processor in allegations of BSA/AML violations before DOJ. DOJ took no action against our client.
  • Representation of a multinational food and beverage company in an internal investigation of alleged money laundering by a prominent licensee in Eastern Europe.
  • Representation of a large higher-education corporation in multiple investigations involving allegations that the company improperly received and used federal funds. DOJ took no action against our client.
  • Representation of the board of a prominent advertising and marketing company in an investigation involving allegations that company insiders improperly obtained and used Paycheck Protection Program funds. DOJ took no action against our client.
  • Representation of a venture capital firm in a DOJ investigation related to sanctions and money laundering.
  • Representation of a retired Federal Bureau of Investigation (FBI) supervisor in connection with a series of investigations by DOJ’s Office of Inspector General, the Office of Special Counsel, and multiple senators and congressmen related to alleged political bias and Hatch Act violations.
  • Representation of three senior managers of a multinational infrastructure company in connection with a DOJ investigation into financial fraud and improper use of federal funds.

  • Representation of a multinational aerospace and defense technology company in conducting third-party due diligence reviews in connection with vetting and onboarding contractors across various jurisdictions.
