Lyndsey Cain is a member of Morrison Foerster’s Commercial Litigation + Trial and Complex Litigation + Advisement Groups. She has extensive courtroom experience, particularly for an associate, having served as lead or co-lead trial counsel in 10 trials, including six felony jury trials. In civil matters, she has drafted and argued numerous substantive and discovery motions in state and federal court, including drafting and arguing a successful motion for preliminary injunction in federal court.

Lyndsey has expertise managing all aspects of civil litigation, including day-to-day strategy, client advisement, opposing counsel correspondence, motions, and court conferences in products liability, toxic tort, professional liability, employment, contract, trade secret, and other commercial litigation matters. She has argued dispositive, discovery, and other motions in both federal and state courts, including handling court conferences and oral arguments independently.

Lyndsey’s discovery experience includes taking and defending expert depositions, and preparation of expert reports. She also has experience with Federal Rule 30(b)(6) witness preparation and taking depositions under Federal Rule 30(b)(6) and state-equivalent rules.

In 2018, Lyndsey received a competitive fellowship position in the Maryland Public Defender’s Office, during which she served as the primary attorney in at least 300 criminal cases, 10 of which proceeded to trial. She delivered at least 15 opening statements or closing arguments at trial, cross-examined at least 30 witnesses, and orally argued dozens of dispositive, evidentiary, and discovery motions.

Before joining Morrison & Foerster, Lyndsey worked at a major D.C.-based law firm and at a Colorado regional firm. She previously served as a law clerk to Chief Judge James C. Dever III of the U.S. District Court, North Carolina Eastern District. Lyndsey earned her J.D. from Duke University School of Law, where she was articles editor of the Duke Law Journal. Concurrently, she earned a Master of Arts in Political Science from Duke University. She also graduated magna cum laude with a Bachelor of Arts in Political Science from Davidson College, where she received High Honors and was in Phi Beta Kappa and Alpha Epsilon Delta honor societies.
