Adam Fleisher focuses on helping clients with all manner of challenges relating to privacy and data security, from compliance strategies to defending FTC and state attorney general regulatory investigations.

Mr. Fleisher works closely with his clients to understand their businesses—and their business needs—to ensure that risks are identified, compliant practices are in place, and any policies or practices under investigation are vigorously defended as needed. He advises clients on compliance with laws and rules, including Section 5 of the Federal Trade Commission (FTC) Act, the Children’s Online Privacy Protection Act (COPPA), the CAN-SPAM Act, and the Telephone Consumer Protection Act (TCPA), as well as on the drafting and revising of their privacy policies, and on privacy due diligence for acquisitions. He also works with clients to prepare cyber incident response plans and respond to incidents both large and small. In that regard, Mr. Fleisher has substantial experience conducting internal investigations to respond to, and defend clients facing, regulatory inquiries relating to consumer protection issues, in particular those arising out of privacy and data security practices.

Mr. Fleisher is well versed in state money-transmitter licensing laws and the Bank Secrecy Act as it applies to money transmitters, and regularly counsels clients on the nature of these laws and their applicability to clients’ existing and proposed practices. He also advises clients on, and works to guide them through, the state money-transmitter licensing and change-of-control processes. He leverages his experience regarding consumer protection regulatory inquiries to assist clients with responses to regulatory inquiries relating to money transmission activities.

Mr. Fleisher received his B.A. from the University of California at Berkeley, his M.A. from the University of Chicago, and his J.D. from the University of Virginia, where he was on the editorial board of the Virginia Law Review. During law school, he also served as a judicial intern for The Honorable Kathryn A. Oberly of the District of Columbia Court of Appeals, and was a clerk for The Institute for Justice.

Prior to attending law school, Mr. Fleisher worked for the Council on Foreign Relations, focusing on international economics, and served as an assistant editor of The National Interest.
