Dr. Can Cui is a member of the Firm’s Technology Transactions Group and one of the “leading practitioners in biotech and life sciences” recognized by Berkeley Center for Law & Technology. His practice focuses on China-related life sciences transactions, including cross-border technology licensing and acquisitions, collaboration and strategic partnerships, and joint ventures and other forms of investments.

Dr. Cui has extensive experience representing both technology licensors and licensees in Life Sciences licensing transactions, both domestic and across the Pacific. In PE/VC investments, he has represented both institutional and individual investors and start-up and established Life Sciences companies in Intellectual Property (“IP”) and technology due diligence and negotiating and drafting investment documentation. Dr. Cui also advises clients on the IP aspects of mergers and acquisitions.

Dr. Cui is also a member of the Firm’s IP Group. For more than ten years, Dr. Cui has prepared and prosecuted numerous patent applications in the United States in the areas of biotechnology, chemistry, medical devices, pharmaceuticals, and Internet technologies. Prior to his arrival in the Bay Area, Dr. Cui was a resident in the Firm’s Hong Kong office for four years, where he managed patent infringement and invalidation proceedings in China on behalf of the Firm’s U.S. technology clients and gained extensive experience in IP dispute resolution in China. He has been invited by top universities in the United States and in China as guest lecturer on U.S. patent law, patent licensing, and IP protection in the biotech industry, and he established and taught Chinese IP Law at The Chinese University of Hong Kong for three years as an adjunct Faculty member.

Dr. Cui has a strong research background in the biological and biomedical sciences. He was the recipient of the Karnovsky Fellowship and the Fu Fellowship at Harvard University, where he obtained his Ph.D. in Biological Chemistry & Molecular Pharmacology. As a graduate student at Harvard, he conceived, established, and maintained a major long-term collaborative project among Harvard Medical School, the University of California, San Diego, and the Chinese Academy of Sciences. His groundbreaking identification of a viral microRNA was featured in the “Spotlight” section of Journal of Virology as an article of significant interest selected by the Editors. Dr. Cui was a Shuping Scholar and valedictorian at Peking University, where he received his B.Sc. in Biotechnology, with High Distinction Honor for his research and senior thesis on anti-breast cancer immunotherapy. In addition to advising academic clients in patent prosecution and other IP matters, Dr. Cui continues to contribute to the scientific research community by serving on the Editorial Review Board of Scientific Journals International as the only Board Member in the Biology Division working outside academia, industry, and government.

Prior to joining Morrison & Foerster, Dr. Cui worked in a top boutique IP law firm in the United States, and then in a prestigious IP group of an international law firm as a U.S. patent agent. Dr. Cui received his J.D., magna cum laude, from New York University School of Law (“NYU Law”), where he was the Senior Articles Editor and Board Member of NYU Journal of Law & Business. He is a member of The Order of the Coif and the recipient of NYU Law’s only Convocation Award in IP Law, the Walter J. Derenberg Prize. Dr. Cui has a continuing scholarly research interest in patent law, particularly subject matter patent eligibility, and in information privacy law, and has published in both areas.
