Jonathan McNeal Smith is a member of the Litigation Department. Mr. Smith practices both intellectual property and commercial litigation, and has handled matters involving patents and copyrights, contract disputes, and corporate officer liability. Mr. Smith has worked on a variety of matters involving technologies related to DVD and Blu-ray authoring, medical devices, software, and oil exploration.
Mr. Smith has experience drafting case-dispositive and claim-construction briefs, drafting invalidity and non-infringement contentions, working with experts on expert opinions, and managing all aspects of discovery. He has experience preparing witnesses for deposition and taking depositions in matters involving complex issues.
Prior to joining Morrison & Foerster, Mr. Smith served as a law clerk to the Honorable Beverly Reid O’Connell at the U.S. District Court for the Central District of California and to the Honorable Arthur L. Alarcón at the U.S. Court of Appeals for the Ninth Circuit in Los Angeles.
Mr. Smith graduated cum laude from Pepperdine University School of Law and, was elected to the Order of the Coif, in 2013. During law school, Mr. Smith was a member of the Pepperdine Law Review and worked as an extern for U.S. District Court Judge Otis D. Wright II and California Court of Appeal Justice Victoria G. Chaney. Mr. Smith received his B.S. in chemical engineering from Brigham Young University in 2010.
Mr. Smith is an active member of the Los Angeles Intellectual Property Law Association (LAIPLA), and currently sits on multiple committees.
Mr. Smith is admitted to practice in California and before the U.S. Patent and Trademark Office. Mr. Smith is fluent in Spanish.
