Nicole Elemen is an associate in our firm’s Employment & Labor Group. Her practice focuses on employment and labor counseling, litigation, administrative proceedings, and workplace investigations.

Nicole counsels employers on all aspects of California and federal employment and labor law, including:

  • Complaints of harassment
  • Disability accommodations
  • Discrimination and retaliation
  • Employee discipline
  • Employee training
  • Employment policies and procedures
  • Hiring and terminations
  • Leave issues
  • Mass layoffs
  • Performance improvement plans
  • Wage and hour issues

She also counsels employers on multinational employment issues related to mergers and acquisitions. Nicole has conducted investigations into alleged workplace misconduct and employee complaints, including harassment, discrimination, and retaliation. She also has conducted wage and hour audits under FLSA and the California Labor Code.  

Employment Litigation and Administrative Proceedings

As a member of our Litigation Department, Nicole represents private employers in litigation in state and federal court regarding harassment, retaliation, discrimination, wrongful termination, constructive discharge, disability and family and medical leave, workplace violence, civil harassment, negligence, and breach of contract disputes. She also litigates wage and hour class actions.

Nicole has experience representing private and public employers at mediations, settlement conferences, hearings, and trials before the Department of Fair Housing and Employment, the Equal Employment Opportunity Commission, the Division of Labor Standards Enforcement, and the Department of Labor.

Labor Law

Nicole represents employers in matters involving union organizing, collective bargaining, grievances, labor relations, and labor arbitrations. She also represents employers in unfair labor practice charges and representation matters before the National Labor Relations Board and the Public Employment Relations Board.

About Nicole

Nicole provides pro bono representation to the Ronald McDonald House Charities-San Diego and also represents veterans through the Wounded Warrior Project. She is a member of the National Asian Pacific American Bar Association, the Mexican American Bar Association, the Latina Lawyers Bar Association, and the Hispanic National Bar Association.

Nicole received her J.D. from UCLA School of Law and her B.A. in dance and political science from the University of California, San Diego.
