Purvi G. Patel is a partner in the Litigation Department and is the hiring partner for Morrison & Foerster’s Los Angeles office. She is a member of the firm’s Consumer Litigation and Class Action and Privacy and Data Security practice groups.

Ms. Patel’s practice includes a broad range of complex litigation in federal and state court, with a focus on defending retailers and manufacturers, among others, in unfair competition, false advertising, consumer fraud, data security, and privacy cases. In tandem with her litigation practice, she regularly counsels clients concerning potential privacy implications of business practices relating to the collection of customer personal identification information in a number of settings. She has a particular expertise regarding California’s Song-Beverly Credit Card Act and analog statutes in effect in other states. In recognition of her expertise, she served as a member of Law360’s Privacy and Consumer Protection Editorial Advisory Board in 2014 and 2015.

In 2015, Ms. Patel was named a Law360 “Rising Star” in the Retail & E-Commerce practice area (one of two attorneys recognized for the honor). She was also recommended by Best Lawyers in America 2017.

In 2014, Ms. Patel participated in the Leadership Council on Legal Diversity’s (LCLD) Fellows program as Morrison & Foerster’s Fellow. The LCLD Fellows Program was established to increase diversity at the leadership levels of U.S. law firms and corporate legal departments. She also serves on the board of the South Asian Bar Association of Southern California Public Interest Foundation, a non-profit committed to organizing, supporting, and promoting public interest activities for the benefit of the South Asian community and the Southern California community at large.

Before joining Morrison & Foerster, Ms. Patel served as a law clerk to the Hon. Consuelo B. Marshall, U.S. District Court for the Central District of California. Prior to her clerkship, she was an associate at McDermott Will & Emery LLP in Chicago.

After graduating from the University of Chicago with a B.A. with honors in history, philosophy, and social studies of science and medicine, Ms. Patel received her J.D. magna cum laude from Loyola University Chicago School of Law. During law school, she was a senior member of the Loyola Law Journal and was named, in 2005, Loyola’s National Association of Women Lawyers’ Outstanding Law Student. In addition to clerking for Judge Marshall and serving as a short-term clerk for the Hon. Blanche M. Manning, U.S. District Court, Northern District of Illinois, Ms. Patel served as an extern to the Hon. Ann Claire Williams of the Seventh Circuit Court of Appeals.

Representative matters include:

  • Advising retailers, banks, credit card companies, and online businesses regarding potential privacy implications of proposed business practices involving collection of personal identification information.
  • Represented national retailers in more than 30 Song-Beverly Credit Card Act and Massachusetts’ Song-Beverly analog matters arising out of the alleged collection of personal identification information, many of which settled on favorable terms or have been dismissed following early negotiations with plaintiffs’ counsel.
  • Representing international beverage company in various lawsuits brought under unfair competition, false advertising, and products liability laws.
  • Second-chaired bench trial for national retailer in class action involving collection of consumer personal identification information.
  • Obtained order denying class certification with prejudice on behalf of household-name company in heavily litigated case involving consumer protection claims arising out of alleged misrepresentations and omissions.
  • Defeated class certification on behalf of national retailer in consumer class action alleging unfair competition, false advertising, and fraud claims.
  • Defeated class certification in unfair competition case against grocery store chain with locations throughout Southern California, and obtained dismissal of putative privacy class action against same grocery store chain, which was affirmed on appeal.
  • Obtained dismissals at motion to dismiss stage on behalf of international beverage company sued for unfair, unlawful, and fraudulent marketing and advertising practices.
  • Defeated wiretapping, eavesdropping, and related common law claims alleged against client in connection with consolidated In re Pellicano civil cases through successful motion for summary judgment on statute of limitations grounds.
