Benjamin Nelson, a former federal prosecutor, focuses his practice on complex commercial litigation and the defense of consumer class actions.

Mr. Nelson defends and counsels a diverse range of clients across a broad range of industries. He has experience litigating in both state and federal courts, including developing and implementing case strategies, drafting and arguing dispositive motions, and taking depositions, guiding numerous clients to successful outcomes.

Mr. Nelson has an active pro bono practice. His experience includes working on litigation related to the disproportionate suspension and expulsion of African American students and students with disabilities and representing an immigrant in her appeal of a removal order before the Ninth Circuit.

Before joining Morrison & Foerster, Mr. Nelson clerked for the Honorable Michael H. Simon, U.S. District Court for the District of Oregon. He was also a Special Assistant U.S. Attorney in the Eastern District of California. During his time as a Special Assistant U.S. Attorney, Mr. Nelson prosecuted federal misdemeanor cases from initial investigation through final disposition and conducted three jury trials and six court trials.

Mr. Nelson previously served as a postgraduate fellow for Earthjustice’s Rocky Mountain Office. He also held numerous internships, including at the Environmental Law Division of the New York City Law Department, the U.S. Environmental Protection Agency, and the Natural Resources Defense Council, to name a few.

Mr. Nelson received his J.D. from Columbia Law School where he was the Notes Editor for the Columbia Journal of Race and Law and the Submissions Editor for the Columbia Journal of Environmental Law. He was also a James Kent Scholar and a Harlan Fiske Stone Scholar.
