Yonatan E. Braude is an attorney in the Litigation Department of Morrison & Foerster’s San Francisco office. Mr. Braude’s practice focuses on complex civil litigation, including antitrust, appellate, class action, commercial, securities, and intellectual property licensing matters. Mr. Braude has successfully represented companies and corporate officers and directors in industries including consumer products, electronics, financial services, information technology, life sciences, and social media.
Mr. Braude has also won significant pro bono victories. Mr. Braude successfully briefed and argued an appeal in the United States Court of Appeals for the Ninth Circuit concerning student loan law, representing the appellant, a student loan debtor. In a precedent-setting opinion that clarified the standards for receiving a discharge of student loan debt in bankruptcy, the Ninth Circuit unanimously reversed the district court’s decision to deny the appellant an undue hardship discharge and granted appellant complete victory. Hedlund v. Educ. Res. Inst., Inc., 718 F.3d 848 (9th Cir. 2013).
Mr. Braude earned his J.D. in 2007 from the University of California, Berkeley, School of Law (Boalt Hall), where he received the Thelen Marrin Award for graduating first in his class.
At Berkeley, Mr. Braude was also elected to the Order of the Coif and served on the California Law Review and the Berkeley Technology Law Journal. He earned Jurisprudence Awards in Federal Courts, Evidence, Civil Procedure I, Civil Procedure II, Torts, and Introduction to Intellectual Property, as well as a Prosser Prize in Income Tax I and a Moot Court Advocacy Award for brief writing and oral argument. During law school, Mr. Braude served as a judicial extern for the Honorable John T. Noonan, Jr. of the U.S. Court of Appeals for the Ninth Circuit in San Francisco. He also worked as a summer law intern at the Civil Division, Appellate Staff of the United States Department of Justice in Washington, D.C.
Mr. Braude earned his B.A., magna cum laude, from Harvard University.
Before joining Morrison & Foerster, Mr. Braude served as a law clerk to the Honorable Stephen F. Williams of the United States Court of Appeals for the D.C. Circuit.
