Patent Litigation

For more than three decades, Morrison & Foerster has been routinely called upon to represent clients in their most high-profile litigations. Today, our deep bench of trial lawyers with substantive patent experience provides clients with a world-class litigation practice, able to address any issue regarding the protection of patents and other IP.

Our 125 IP litigators include top trial and appellate lawyers in the U.S. and Asia, where we regularly litigate highly complex cases involving cross-border matters, cutting-edge technologies, and multiple-party disputes.

Clients laud our team for its excellent courtroom skills, its ability to analyze key issues in a case and to develop novel solutions, and its depth of experience across industries. We have the distinguishing ability to handle issues of any complexity, in any venue, involving any technology. Leading third-party guides to the legal industry have taken notice: Year in and year out, we are ranked by Chambers Global, U.S. and Asia, as among the top-ranked IP practices in the world. Our accolades include, among others, Chambers USA’s 2013 IP Firm of the Year, Law360’s 2014 IP Practice Group of the Year, and being named a 2014 IP Litigation Powerhouse and a 2015 IP VIP by BTI Litigation Outlook. In 2017, we were once again named to the National Law Journal’s IP Hotlist, and Legal 500 US recommended us again last year as Top Tier for Patent Litigation. We are perennially top-ranked for IP litigation and patent litigation by U.S. News – Best Lawyers, and 2017 was no exception.

Collaboration is the hallmark of the firm. Our clients benefit not only from the courtroom prowess of our litigators–and their ability to resolve disputes short of trial–but also from the experienced patent prosecutors and licensing specialists who bring their sophisticated technical insights to bear in shaping our winning litigation strategies. The firm’s highly collaborative culture and integration across practice groups is truly unique among law firms. We find this approach ensures that every matter is staffed with individuals with the most relevant experience, whether that is in the courtroom or, when needed, with specialized technical training and licensing know-how. We draw on 66 lawyers, patent agents, and scientific analysts with technical and scientific PhDs, and many more with experience as engineers and scientists in technical professions. This collaborative approach is what clients tell us they need from their IP counsel, and it sets MoFo apart from other firms.

Additionally, we are one of a small number of U.S. law firms with a significant international IP litigation practice, and we are widely recognized as one of the strongest global IP litigation firms. The Asian Legal Business Japan Law Awards honored us again with its 2015 IP Law Firm of the Year award, and ranked us Tier 1 for Patents in its 2017 China & Japan International firms table. Our Tokyo IP litigation team frequently appears in all of the U.S. federal district courts that handle high volumes of patent litigation, as well as in the U.S. International Trade Commission and the U.S. Court of Appeals for the Federal Circuit.

Good Technology Corp. v. AirWatch LLC
