The group advises public and private sector organisations from a wide range of industries including life sciences and pharmaceutical; insurance; financial services; IT, telecommunications and media; recruitment and employment; and data management and storage.
The team has expertise dealing with the employment aspects of outsourcing, privatisation, and other forms of corporate and group change, including mergers and acquisitions, joint ventures, and restructurings. In particular, we regularly advise on the outsourcing of HR services. HR outsourcing is a very active section of the market, powered by companies seeking more efficient, cost-effective, and harmonised processes to support the administration of human resources. We have extensive experience advising both customers and suppliers on all human resources issues involved in sourcing transactions, such as the impact of TUPE and obligations relating to consulting with employees.
We are a leader in advising on legal issues relating to privacy and trans-border data transfers around the world. Working across practice groups and offices, the employment team represents companies on a wide array of privacy issues and transactions involving personal data, both domestically and internationally. We assist clients with issues such as complying with applicable privacy laws and regulations (including notification to the relevant authorities), developing and implementing privacy policies and training and awareness programmes, and performing large and small scale data audits.
The team provides employment counselling on issues such as service agreements and contracts of employment, employee benefits including share options, discrimination, fiduciary duties, employee intellectual property considerations, and confidentiality and non-compete agreements.
We also offer capabilities in contentious employment matters, advising on matters before all courts and employment tribunals. However, we recognise that litigation can be costly and time consuming so where possible we work to provide preventive lawyering. We look at early intervention and dispute avoidance and informal in-house mediation and we also have expertise in formal mediation, arbitration, and ADR.
