In Berlin, we advise public entities as well as service providers and product suppliers on the legal and business issues involved in the submission and collection of bid documents related to invitations to tender. We also assist clients with litigation arising out of questionable tendering procedures and with complaints to the European Commission.

In the UK, we advise public entities as well as service providers and product suppliers on the legal and business issues involved throughout the entire contracting cycle, including proposal preparation, negotiations, and compliance.  We also assist clients with bid protests, procurement litigation, and contract disputes (including litigation and arbitration).  Where contracts involve proprietary research or technology transfer, our attorneys also provide counsel on intellectual property protection.

Representative Matters

HM Revenue and Customs: We have worked extensively with HM Revenue and Customs (HMRC) for over a decade on its major projects.  Our work covers regulatory and statutory compliance, procurement law, commercial agreements, and litigation/disputes.  HMRC runs the second largest IT estate in the UK.  Our team has advised HMRC for many years on commercial and procurement issues related to its technology estate and large technology projects.

Currently, we are advising HMRC on the commercial and legal implications of its project to change the way in which payroll tax submissions are made by switching to a “real time information” basis and aligning employer’s tax submission data to be made over the BACS payroll payment system.

National Policing Improvement Agency: We have advised the National Policing Improvement Agency (NPIA) for many years on some of its most complex and high-profile IT and telecommunications projects, including on its contract with Airwave Services Limited relating to the provision of the digital encrypted “Airwave” national radio communications service for all police forces in England, Scotland, and Wales.  Our team advised on the original procurement, contract award, and roll-out of this service via a pathfinder PFI/PPP project.  Our role covered all contract drafting and advisory work, as well as dealing with issues arising from possible bidder procurement challenges.

We also advised NPIA on a £122 million re-tender project (“IDENT1”) of advanced biometric identification and fingerprint technology for the police forces of England, Scotland, and Wales and other criminal justice organisations in the UK. We assisted NPIA to create a long-term contract that was sufficiently flexible to facilitate the rapid, ongoing developments in biometric services, mobile fingerprint checking, facial imaging, and video identification.

UK Border Agency: We have advised the UK Border Agency (UKBA) on its £297 million business process outsourcing contracts relating to the operation of the UK’s visa application process.  We helped UKBA to deliver this hugely challenging project on budget and within agreed timescales.  This project won the award for “e-Government Excellence: Innovation in Strategy” at the e-Government National Awards.
