Please join us for Morrison & Foerster’s presentation on the state of the law on inequitable conduct, a 1 hour interactive program designed to let prosecutors in particular know about the current trends in inequitable conduct.

We’ll first focus on what is inequitable conduct, particularly the two key elements materiality and intent before and after Therasense. We’ll then turn to equitable attacks on patents, discussing some of the recent case developments on inequitable conduct and unclean hands defenses. We’ll discuss Gilead Sciences Inc. v. Merck & Co. Inc., and Regeneron Pharms., Inc. v. Merus N.V. We’ll conclude with key takeaways and practical advice to help prosecutors avoid inequitable conduct allegations in litigation.
