In this session, we will give an update on the state of play of derivatives regulation on both sides of the Atlantic.  We will cover not only certain substantive U.S. and EU regulations but also the potentially complex cross-border aspects of their application.  Topics will include:

  • How U.S. and EU regulations approach the cross-border application of substantive requirements;
  • The recent U.S.-EU accord regarding the regulation of central counterparties; and
  • Substantive regulatory requirements for uncleared swaps from a cross-border perspective, including clearing, exchange trading and margin.
