This session will focus on contracting best practices and innovations, especially those involving large-scale international RE/FM outsourcing agreements. Such contracts must accommodate many complexities while aligning incentives to encourage superior performance and creating clear lines of responsibility and accountability on both sides of the relationship. Legal experts will discuss the state of the art in outcome-based, multi-site, multi-country master service agreements, and will examine the key elements of EU FM outsourcing contracts that every CRE/FM executive must know prior to negotiating an FM outsourcing deal.  Employment and labor issues will receive special attention, including drafting to avoid or mitigate the risks associated with the application of the Acquired Rights Directive and TUPE Regulations, dealing with any subsequent transfers or terminations of employment, and accommodating information, consultation and co-determination rights of works councils.
