The world of corporate criminal enforcement has witnessed an aggressive use of DPAs and NPAs by the U.S. Department of Justice. As stated by Assistant AG Leslie Caldwell, these negotiated resolutions have enabled DOJ to “impose reforms, impose compliance controls, and impose all sorts of behavioral change.” Together with the benefits of such agreements have come the demands of implementing compliance programs and fulfilling reporting obligations. As the use of DPAs and NPAs has continued to evolve, the year 2015 has witnessed such unprecedented developments as the risk of DOJ revoking an NPA; the prospect of judicial intervention in DPA oversight; and NPA resolutions arising out of the DOJ Tax Division's Swiss Bank program.
