Insider Trading - 2018 Annual Review

The crime of insider trading is a straightforward concept that some courts have somehow managed to complicate, lamented United States District Court Judge Jed Rakoff in December 2018.  Prosecutors and courts alike grappled with the complicated state of insider trading law in 2018—a year that will likely be remembered for continual confusion as to precisely how to define insider trading.  That confusion did not stem the tide of new criminal and civil cases, however, leaving observers with much to monitor on the insider trading front.
