The EU’s General Data Protection Regulation gives authorities discretionary power for setting penalties, but it doesn’t say how penalties should be determined. Alex van der Wolk, global co-chair of Morrison & Foerster’s Privacy and Data Security Group, and Karine e Silva, a privacy analyst in the firm’s Brussels office, say the first year of GDPR fines shows the need for specific guidelines for consistent enforcement.
