With his doctoral thesis, MoFo’s Jan Frohloff presents the first comprehensive study on the obligations that arise from an arbitration agreement and the consequences of a breach under German law. He derives five obligations of the parties to an arbitration agreement and analyzes if a party in breach of an obligation is liable for damages, if an arbitral tribunal has jurisdiction over such disputes and if the other party can terminate the arbitration agreement in case of a breach.
