This article traces the rise of the "private Surgeon General" from its nonexistence just a few years ago to its phenomenal expansion today and suggests ways that manufacturers and retailers can stay ahead of the summons and, if they wind up getting sued, harness the unsympathetic nature of these cases into arguments that maximize the chances of winning a dismissal outright.
