Fokker DPA expired during DC appeals court battle

James Koukios, a partner in Morrison & Foerster's securities litigation, enforcement and white-collar defense practice group and former senior deputy chief of the Justice Department's fraud section, was quoted in the article “Fokker DPA expired during DC appeals court battle”.

James Koukios at Morrison & Foerster in Washington, DC said it is “extremely interesting” that the DPA has already expired.

“The government started the clock on the DPA as soon as the charges were filed, despite Judge Leon’s decision to effectively reject the settlement.” Koukios said. “This is completely fresh territory – whether the DPA should be considered effective as soon as charges are filed, regardless of Judge Leon’s decision, was far from certain.”
