Chuck Comey, a partner in Morrison & Foerster’s Corporate Department who regularly advises Chinese acquirers on U.S. targets, was quoted regarding Aixtron in the article, “Aixtron Shares Slump on Reports Obama Will Reject China Takeover,” published by The Deal on December 2, 2016.

That President Obama is likely to block the deal shouldn't be a surprise said Mr. Comey, who advises clients on CFIUS matters.

"It's hard to imagine a scenario in which the CFIUS review has gotten this far and to this posture that there could be some persuasive advocacy by the parties to change the government's position," he said. Merging parties identify national security concerns that can be addressed with mitigation conditions at the beginning of the talks with CFIUS. "That there hasn't been a solution yet means it's quite unlikely that there will be some change of heart. I'd be very surprised if the president acted out of concert with the agency's view."
