National Law Journal Honors James Schurz as a Winning Litigator

The National Law Journal has named San Francisco partner James Schurz to its list of Winning Litigators for 2016 in recognition of his role in securing a judgment for Lumber Liquidators in April.

In a case that potentially could have cost Lumber Liquidators billions of dollars, James was able to successfully argue the company did not fail to comply with California’s product standards under Proposition 65.

Lumber Liquidators was faced with lawsuits asserting the company failed to properly warn customers of the excessive levels of formaldehyde in its wood flooring.

James proved that Lumber Liquidators had indeed provided “clear and reasonable” warning, citing invoice warnings and discrediting the plaintiff’s consumer expert.

“It is often stated, and is still sound advice,” says James “that trials are won by presenting a simple, compelling, fact-based theme—not a hodgepodge of theories but one, overarching truth.”

The annual Winning Litigators series honors the accomplishments of winning litigators who have set a legal precedent or succeeded in the face of significant damages at stake.
