CFPB Set for Early February Court Test of Investigative Powers

Don Lampe, a partner in Morrison & Foerster’s Financial Services Group, commented on the issue of jurisdiction presented in CFPB v. Accrediting Council for Independent Colleges and Schools (ACICS) in the article “CFPB Set for Early February Court Test of Investigative Powers,” published by Bloomberg BNA Banking Report on January 2, 2017. 

“This case has been in the background because so much attention has been on the PHH case, but it's still very important in determining the Bureau's authority under Dodd-Frank,” said Mr. Lampe.

“The basic jurisdiction of the agency is an important issue no matter what happens in the next few months,” Mr. Lampe said. “As long as there's a CFPB in Washington, any limits on its jurisdiction will be important.”
