New Patent Litigation Rules Require Earlier Damages Estimates

“Not all lawyers were as bullish. ‘The countervailing view is that it's going to increase expenses in the earlier stages,’ said Morrison & Foerster partner Matthew Chivvis. Parties may have to hire damages experts and divulge sensitive financial information when a claim construction order is what's really needed to resolve a case, he said.”
