New Patent Litigation Rules Require Earlier Damages Estimates

Matthew Chivvis, partner in the firm’s Intellectual Property Group, where he represents high-tech, Internet, and life sciences companies in a variety of matters, was quoted in The Recorder article “New Patent Litigation Rules Require Earlier Damages Estimates” regarding the Northern District of California taking a bold step by adding damages to the list of early disclosures in patent litigation.

“Not all lawyers were as bullish. ‘The countervailing view is that it's going to increase expenses in the earlier stages,’ said Morrison & Foerster partner Matthew Chivvis. Parties may have to hire damages experts and divulge sensitive financial information when a claim construction order is what's really needed to resolve a case, he said.”
