Natural Gas Power PlantMorrison & Foerster LLP provided legal advice to the New York arm of Axium Infrastructure Inc., an energy infrastructure private equity fund headquartered in Montreal, Canada, in its acquisition of slightly less than half of Capital Dynamics’ equity stake in the 475 MW Kings Mountain and the 518 MW Middletown projects in North Carolina and Ohio, respectively. Both natural gasfired projects are being developed by NTE Energy, are currently under construction and are set to reach commercial operation in 2018.

The core MoFo team was led by New York-based M&A partner Jonathan Melmed who is Co-Chair of Global Private Equity as well as Co-Chair of Global Energy & Infrastructure and also included New York-based M&A/PE counsel Adam Hankiss, and New York-based M&A/PE associates Egbert de Groot, and M&A/PE international visiting attorney Gabriel Mundim with tax support from New York-based tax counsel Craig Phillips and energy regulatory support from D.C. based energy regulatory counsel Zori Ferkin and DC-based CFIUS/HSR counsel Aki Bayz and San Francisco-based associate Lala Wu for environmental matters and Northern Virginia-based associate Susan Borschel for real estate matters.
