Morrison & Foerster partner Mark L. Whitaker was the focus of a recent question and answer feature for IPPro Patents to discuss the oral arguments heard in TC Heartland v. Kraft Foods. At issue is “forum shopping” centered on the U.S. District Court for the Eastern District of Texas, which has been historically favorable to the patent owner. In addition to presenting the arguments on both sides, Mr. Whitaker dissected where the justices may be leaning, and whether the case could end up as a back and forth between the courts and Congress.
