In the Law360 article “Arguments In Debt Collection Case To Focus On Law’s Reach,” Morrison & Foerster partner Joseph R. Palmore is quoted about the threat that banks and consumer finance firms face being regulated by the Fair Debt Collection Practices Act. The argument is playing out in Henson v. Santander Consumer USA.

“This case involves an effort to dramatically expand one of those definitions and sweep in a whole lot of financial institutions that don’t look like the independent debt collectors that Congress was concerned about,” he said.
