How Much Will Equifax Pay?

Despite courts having repeatedly found in the past that the Fair Credit Reporting Act does not apply to data breaches due to the wording in the statute, partner Nathan D. Taylor does not believe claims will be negated this early in the process.

“The company isn’t going to completely avoid litigation because of something that people would characterize as a technicality,” he said in the Bloomberg Businessweek article “How Much Will Equifax Pay?”

On settlement figures predicted for those affected by the breach, Mr. Taylor predicts they will be in line with those of similar instances that have come before.
