EPA Administrator Scott Pruitt’s comments that California should not dictate auto emission standards to the rest of the country signals his intent to challenge the state over the rollback of greenhouse gas vehicle emission standards according to Morrison & Foerster partner Michael Jacob Steel.

“That’s basically a shot saying, ‘We may not allow California to have the independence that it has had since the Clean Air Act was enacted back in 1970 and may basically try to overrule California’s independence by either revoking their waiver or denying a future waiver as to these standards,’” Mr. Steel said in the Law360 article “4 Takeaways From EPA’s Vehicle GHG Emission Review.”
