Auto Suppliers Fear EPA Fuel Economy Process Lacks Data, Certainty

According to Ali A. Zaidi in the Bloomberg BNA article “Auto Suppliers Fear EPA Fuel Economy Process Lacks Data, Certainty,” the EPA’s determination that greenhouse gas limits for model year 2022 – 2025 passenger cars are not appropriate and should be revised lacks the data needed to avoid legal vulnerabilities.

“Administrative law usually asks the question, ‘Why?’ It usually doesn’t settle for assertions. And I think the big challenge with this document is it makes a lot of assertions but doesn’t answer the question, ‘Why?’” he said.

“Where there’s a divergence from the technical record that EPA put forward in 2016, the agency should be transparent about it and trace clear lines from the conclusion it’s reached,” he added.
