Judge Rules California Literacy Case May Move Forward

A civil rights lawsuit filed by Morrison & Foerster and pro bono law firm Public Counsel is allowed to move forward, thanks to a ruling from a Los Angeles Superior Court Judge that was made public on Monday. Judge Yvette Palazuelos issued an order on July 18th denying the State of California’s demurrer and allowing the court to hear evidence on the case.

The case, Ella T. v. State of California, is a landmark education case brought under the California Constitution that seeks to vindicate the right of all students to access literacy. The firm filed the case with Public Counsel on behalf of California students – who are mostly low-income and students of color – who have been deprived access to literacy.
