MoFo Blocks Texas Law that Hinders Women’s Right to Choose

A Morrison & Foerster pro bono team secured a win on behalf of client Whole Woman’s Health when Senior U.S. District Judge David Ezra issued a permanent injunction on the Texas law, SB 8. The law, which passed in 2017, required health care providers to bury or cremate fetal remains which Judge Ezra ruled violated the equal protection and due process clauses of the Fourteenth Amendment of the U.S. Constitution.

It is the second win in the last 12 months for MoFo in Texas for women’s reproductive rights after the firm successfully argued that a law restricting dilation and evacuation abortion, the most common form of second-trimester abortion, was unconstitutional in November 2017.
