“It’s fair to say the Supreme Court isn’t showing the deference to the SEC that it has wanted in these cases,” said Morrison & Foerster partner Michael D. Birnbaum on Lorenzo v. SEC in the Wall Street Journal article “Supreme Court to Rule on Kavanaugh Appeals Court SEC Case.” There have been “real consequences” for the SEC from the previous rulings, though the commission is finding other ways to pursue similar alleged wrongdoing, and one would expect the same would happen if the commission loses the Lorenzo case, he said.
