NPC Enacts Foreign Investment Law

GC Agenda China

March 2019

The March edition of GC Agenda China (subscription required) featured Morrison & Foerster partner Paul McKenzie’s comments on the new Foreign Investment Law that was passed by the National People's Congress.

According to Mr. McKenzie: “Enactment of the Foreign Investment Law is a major milestone in China's regulation of foreign investment. But it is only the beginning of the process. MOFCOM officials are already hard at work to prepare implementation regulations and standards needed to animate the various changes that will affect the incorporation and governance of FIEs. A broader set of legislative changes will be needed to implement other provisions of the Foreign Investment Law. Watch this space over the months leading up to the January 1, 2020 coming into effect of the Foreign Investment Law.”
