In the Bloomberg Law article “Kagan, and Maybe Kavanaugh, Join Roberts in High Court’s Center”, Morrison & Foerster’s D.C. Managing Partner and Co-chair of the firm's Appellate and Supreme Court Practice Group Joseph Palmore was quoted on Supreme Court Justices Stephen Breyer and Elena Kagan joining the High Court’s judicial middle.
Following Chief Justice John Roberts, some Supreme Court justices are also staking out a place in the court’s judicial middle. Joseph stated that both Kagan and Breyer are “consensus builders” pointing to a recent court decision that allowed a large Latin cross to remain on public property in which Breyer and Kagan joined their conservative colleagues in a 7-2 decision.
