In the October edition of GC Agenda China (subscription required), Morrison & Foerster partner Paul McKenzie shared his opinions on the third reading of the Civil Code Rights of Personality conducted by the National People's Congress Standing Committee.
According to Mr. McKenzie: “The promulgation of China's Cyber Security Law and ancillary measures has attracted a great deal of attention within privacy circles, far less so the development of this section of China's Civil Code. And yet the Civil Code has much broader relevance and will prove enormously influential in the development of data privacy standards in China. Drafting work seems likely to continue at a brisk pace, with a drafting schedule that contemplates formulation of a consolidated draft Civil Code incorporating this and the other five sections of the Civil Code in December 2019. ”
