A team of Morrison & Foerster litigators defeated class certification for our client Unilever in a long-running false advertising suit for its vegetable oil “I Can’t Believe It’s Not Butter!” spray.
On July 10, Judge Jeffrey White of the Northern District of California denied class certification to plaintiffs and the proposed damages model in Pardini v. Unilever United States, noting that the plaintiffs did not meet the requirements of purchasing the product within the required six-month timeframe when the “0g fat” statement appeared in advertising of the vegetable oil “I Can’t Believe It’s Not Butter!” spray.
