Schrems II Sparks Data Transfer Chaos and Confusion
Miriam Wugmeister spoke to Global Data Review about the European Court of Justice’s decision to invalidate the EU-U.S. Privacy Shield, forcing companies to rethink how they handle international data transfers.
According to Miriam, data controllers’ newly boosted responsibility to consider third-country data protection regimes is a “big burden to bear,” adding that “it is questionable whether it is appropriate to put this burden with companies.”
“The court’s decision may well put companies between a rock and a hard place, as the underlying issue – namely governments’ potential access to data – is not theirs to fix,” Miriam said. “The problem is political, and it is for governments to fix. This is similar to the situation that companies found themselves in after the Safe Harbour invalidation in 2015.”
