NPC Standing Committee Circulates Draft Data Security Law
In the July edition of GC Agenda China (subscription required), Morrison & Foerster partner Paul McKenzie commented on the Data Security Law (Draft) circulated by the NPC Standing Committee on 3 July 2020.
"International companies ought to monitor progress of the drafting of the Data Security Law closely. It builds in a significant way on the foundation of the Cybersecurity Law 2016 and would formalise a new system for the protection of strategically important data that would sit alongside but be separate from the evolving legislative framework for the protection of personal data, where a first draft of an omnibus Personal Information Protection Law is expected later this year. Significant changes to the draft law might be expected as it proceeds through the legislative process, but we can expect that process to be reasonably brisk as the government continues to strengthen the protection of national security and data security," said Paul.
