The Supreme Court Brief covered a study by Joe Palmore and Samuel Goldstein that looks into how Federal Circuit and its judges fare before the U.S. Supreme Court Justices. Samuel is a former associate of Morrison & Foerster’s Appellate + Supreme Court practice before departing the firm for a judicial clerkship.
“So what of the perception that the Supreme Court grants review from the Federal Circuit to reverse? The data suggests that, whatever the Supreme Court may intend when it grants, that’s not how it plays out – or, at least, no more so than for other courts of appeals,” Joe and Samuel reported. “The bottom line: the Federal Circuit holds its own at the Supreme Court.”
