A Supreme Court ruling in April effectively stripped the Federal Trade Commission (FTC) of its ability to recoup money from lawbreakers in federal court, leaving both the agency and lawmakers scrambling to fill the gap.
The vacuum takes away a significant bargaining chip that the FTC may otherwise hold, according to David. He added that the high court ruling “dramatically changes the bargaining leverage when you’re negotiating a settlement with 13(b).”
