Morrison Foerster partner Sarah Thomas is quoted in an article, “LIDW22: Reasons for optimism in East Asia and the Middle East” published by International Comparative Legal Guides (ICLG) Commercial Dispute Resolution on May 9, 2022.

Sarah noted the difference between the large number of private equity disputes which tend to settle without resorting to formal dispute resolution mechanism, as opposed to joint venture disputes which commonly proceeded to arbitration “which can be challenging to handle especially if there is a need to arbitrate in China”. She was “not convinced that other forms of alternative dispute resolution (ADR) are helpful in the Asia context, as I don’t think by and large in Asia there is a strong enough stable of mediators who are in a position to help parties resolve their disputes”.
