Deal Drivers reflects the strong pace of North American merger activity. The strengthened attitude of strategic buyers was something we at Morrison & Foerster experienced directly in several deals this year, including the proposed combination of Inamed Corporation and Medicis Pharmaceutical Corporation, and JDS Uniphase’s purchase of Acterna Corp. We also have seen continued interest by private equity buyers, with buyouts well on course to exceed 2004 value levels in the full year. The global interest in North American M&A also continues to grow. Buyers from China, for example, are looking to the U.S. for acquisitions, which as has been seen presents both major opportunities and some challenges for U.S. companies and regulators.
