Justice Dept. Seeks to Ease Path for Corporate Prosecutions

James Koukios, former Senior Deputy Chief of the Department of Justice Criminal Division Fraud Section and partner in the firm’s Securities Litigation, Enforcement & White-Collar Defense Practice Group, noted that the Yates Memo’s “all or nothing” approach to corporate cooperation could serve as a disincentive for companies to cooperate, especially if there is confusion about how much credit they will receive.
