MoFo Represents Apex in 300 MW Balko Wind Project Sale

Morrison & Foerster has just concluded the final PPA for Apex Clean Energy’s 300 megawatt (MW) Balko Wind project, which will produce enough electricity to power 110,000 U.S. homes.

The firm was counsel for Apex in its deal to sell the remaining 100 MW of wind energy capacity from its 300 MW Balko Wind Project through a Renewable Energy Purchase Agreement with the Western Farmers Electric Cooperative. The deal is expected to come online in 2015 and WFEC’s total power capacity will rise to 1,850 MW.

The Morrison & Foerster deal team also represented Apex in the sale of the other 200 MW to The Public Service Company of Oklahoma, an American Electric Power subsidiary, last month. Apex previously developed, built and sold the 300 MW Canadian Hills wind project, which launched outside Oklahoma City in 2012. The same deal team counseled Apex in that deal as well.

Jeff Chester, a partner in the firm’s Los Angeles office, led the deal team. He was assisted by Los Angeles of counsel Elizabeth Sluder, San Francisco of counsel Michael Ginsburg, Washington, D.C. of counsel Zori Ferkin, Los Angeles associate Julia Schiesel and San Francisco associate Michelle Jewett.
