James Koukios, former Senior Deputy Chief of the Department of Justice Criminal Division Fraud Section and partner in the firm’s Securities Litigation, Enforcement & White-Collar Defense Practice Group, questioned whether the Department of Justice would strictly follow the Yates Memo’s “all or nothing” approach to corporate cooperation and, if so, whether that strategy would “result in companies being less likely to self report and less likely to cooperate.”
